Lilipro IT Limited provides World Wide Web page hosting. Lilipro IT Limited reserves the right to suspend or cancel a customer's access to any or all of the services provided by Lilipro IT Limited when Lilipro IT Limited decides that the account has been used inappropriately.
Accounts are to be used by the primary owner only, be it an individual or company. Account holders are not permitted to resell, store or give away web-hosting services of their website to other parties, unless prior permission has been obtained from Lilipro IT Limited. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this include ad banners, classified ads and personal ads.
Lilipro IT Limited reserves the right to refuse service and/or access to its servers to anyone.
Lilipro IT Limited does not allow any of the following content to be stored on its servers:
- Illegal material - this includes but is not limited to copyrighted works, commercial audio, video or music files without express permission of the copyright owner, and any material in violation of any Federal, State or Local regulation.
- Adult Material - includes all pornography, erotic images or otherwise lewd or obscene conduct. The designation of "adult material" is left to the discretion of Lilipro IT Limited.
- Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing etc., and encrypting of any of the above. Also includes any sites which provides "links to" or "how to" information about such material.
If copyrighted material other than the holder of the account's own is stored on a server operated by Lilipro IT Limited, we must receive a signed photocopy or original letter giving explicit, specific permission from the copyright holder.
Data stored on our servers is backed up for Disaster Recovery Purposes Only. It is highly recommended that you keep an independent backup of all data stored in your account.
Users must not participate in any form of un-solicited bulk e-mailing or spam.
Lilipro IT Limited operates a sliding scale of bandwidth usage, pre-paid in 1GB blocks. If a website goes over its assigned bandwidth usage then an additional charge shall apply.
Resources are defined as bandwidth and/or processor utilisation. When a website is found to be monopolising the resources available Lilipro IT Limited reserves the right to suspend the site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers. If this policy is to be implemented, the customer will usually be informed with five working day's notice and offered an option where Lilipro IT Limited continues to host the website for an additional fee.
All accounts are set up on a prepay basis. Although Lilipro IT Limited reserves the right to change prices of accounts or services at any time, all pricing is guaranteed for the period of prepayment. Payment is due each anniversary year following the date the account was established. Customers will automatically be charged again at the end of the prepay period unless closure notification has already been given.
Customers will be invoiced one week before the payment due date either by traditional post or by email as agreed with Lilipro IT Limited. All payment is in UK sterling.
Services can be paid for either by cheque or a direct BACS transfer into the bank account of Lilipro IT Limited. Lilipro IT Limited cannot guarantee that a service will be provided until after any received cheques have been cleared.
Lilipro IT Limited reserves the right to cancel the service at any time. In this event customers will be entitled to a pro-rata refund based upon the remaining period of membership and will receive a one month prior warning notice to enable alternative providers to be found, if possible. If a customer contravenes Lilipro IT Limited's terms of service a refund will not be issued in the event of a cancellation.
Customers may cancel their account at any time. Fees charged are refundable at the discretion of the management. In addition, some accounts incur set-up fees, these charges are also non-refundable.
The customer agrees that it shall defend, indemnify, save and hold Lilipro IT Limited harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Lilipro IT Limited, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. The customer agrees to defend, indemnify and hold harmless Lilipro IT Limited against liabilities arising out of (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Lilipro IT Limited's server, (2) any material supplied by the customer infringing or allegedly infringing on the proprietary rights of a third party, (3) copyright infringement and (4) any defective products sold to a customer from Lilipro IT Limited's servers.
Lilipro IT Limited will not be responsible for any damages your business may suffer. Lilipro IT Limited makes no warranties of any kind, expressed or implied for services we provide. Lilipro IT Limited disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery and any or all service interruptions caused by Lilipro IT Limited and its employees. Lilipro IT Limited reserves the right to revise its policies at any time.
